Please read these Terms of Use carefully before using StoryPal. By accessing or using story-pal.ai, our phone-based creation service, or any other StoryPal service that links to these Terms (collectively, the "Services"), you agree to be bound by them. If you do not agree, do not use the Services.
IMPORTANT: SECTION 16 CONTAINS A DISPUTE RESOLUTION AND ARBITRATION CLAUSE THAT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ IT CAREFULLY.
Our Privacy Policy is incorporated into these Terms by reference. By accepting these Terms, you acknowledge that you have read and understood the Privacy Policy.
These Terms of Use constitute a legally binding agreement between you and StoryPal ("StoryPal," "we," "us," or "our"). By creating an account, accessing the Services, or using any StoryPal feature — including the phone creation line at 508-938-8784 — you represent that you have read, understood, and agree to these Terms.
If you are using the Services on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms, and references to "you" include both you as an individual and that organization.
No agency, partnership, joint venture, or employment relationship is created by these Terms.
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or by posting a prominent notice within the Services before the changes take effect. The updated Terms will show a revised "Last updated" date at the top of this page.
Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Services.
To access most Services, you must register for an account. You may sign in using Google OAuth or another supported authentication method. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to: (i) keep your credentials secure and not share them with others; (ii) notify us immediately at support@story-pal.ai if you suspect unauthorized access to your account; and (iii) sign out of your account at the end of each session on shared devices. We are not liable for losses resulting from unauthorized use of your account where you have failed to maintain the security of your credentials.
You must be at least 13 years of age to use the Services. By registering, you represent that you meet this age requirement. If you are between 13 and 18 years of age, your parent or legal guardian must review and agree to these Terms on your behalf before you use the Services.
By creating an account, you agree to receive transactional emails related to your account — such as receipts, subscription confirmations, and security notices. These are necessary for the operation of your account and cannot be opted out of. You may separately opt out of marketing and newsletter emails at any time using the unsubscribe link in those emails.
StoryPal offers free and paid subscription plans. Free accounts are subject to usage limits (currently 3 stories per month). We reserve the right to modify free tier limits at any time with reasonable notice. Paid plans ("Creator" and "Pro") provide additional story credits, features, and distribution tools as described on our Pricing page.
Paid subscriptions are billed monthly on a recurring basis. By subscribing, you authorize StoryPal and our payment processor (Stripe) to charge your designated payment method on each renewal date. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You agree to keep your payment information current and accurate.
You may cancel your subscription at any time through your account settings or by contacting us at support@story-pal.ai. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then. We do not provide refunds for the unused portion of a billing period.
Subscription fees are non-refundable except where required by applicable law. If we suspend or terminate your account due to a breach of these Terms, you will not receive a refund for any unused subscription period or unused story credits. If you believe a charge was made in error, contact us within 30 days of the charge at support@story-pal.ai.
We may change subscription prices at any time. We will provide at least 30 days' advance notice of any price increase, via email or a notice within the Services. Your continued use of a paid subscription after the effective date of a price change constitutes acceptance of the new price. If you do not agree to a price change, you must cancel your subscription before the new price takes effect.
Prices shown do not include applicable taxes. You are responsible for any sales, use, value-added, or other taxes applicable to your purchase, except taxes on StoryPal's net income. Where required by law, we will collect and remit applicable taxes on your behalf.
Payments are processed by Stripe. Your use of Stripe's services is governed by Stripe's own terms and privacy policy. By providing your payment information, you authorize StoryPal and Stripe to charge your payment method as described in these Terms. You represent that you are authorized to use the payment method you provide.
We may offer the ability to purchase additional story credits beyond your monthly subscription allowance ("Credit Top-Ups"). Credit Top-Ups are non-refundable, non-transferable, and expire if your account is closed or terminated.
You retain ownership of the prompts you submit to StoryPal and any original creative input you provide ("User Content"). The AI-generated stories, audio, and other outputs produced from your prompts ("Generated Content") are made available to you under the terms described below.
You are solely responsible for the User Content you submit. You represent and warrant that: (i) you have all rights necessary to submit the content; (ii) your content does not infringe any third party's intellectual property rights, privacy rights, or other rights; (iii) your content does not violate any applicable law; and (iv) your content is accurate to the best of your knowledge where accuracy is material.
Stories you create through StoryPal are displayed publicly in the StoryPal story library by default, allowing other users to discover and play them. If you do not want a story displayed publicly, you may delete it from your account. Stories approved for podcast distribution may be indexed by third-party platforms — we cannot guarantee removal from external systems after distribution.
Stories created on Free and Creator tier accounts are distributed with "Made with StoryPal" attribution on shared outputs, episode pages, and RSS feeds. This attribution serves as the discovery mechanism that allows new users to find StoryPal. Pro tier subscribers may remove StoryPal branding under the white-label feature. You agree to maintain required attribution unless you have an active Pro subscription with white-label enabled.
By submitting User Content or creating stories through the Services, you grant StoryPal a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, store, reproduce, display, distribute, and create derivative works of your content solely for the purposes of: (i) operating and providing the Services; (ii) displaying your stories in the public library; (iii) distributing your stories via podcast RSS feeds you have approved; and (iv) promoting StoryPal using examples of content created on the platform (e.g., in marketing materials, with attribution to you).
You also grant StoryPal a perpetual, irrevocable, royalty-free license to use aggregated, de-identified data derived from your use of the Services — such as prompt patterns, genre distributions, and engagement signals — to improve, develop, and promote our Services.
You grant StoryPal a royalty-free, worldwide, perpetual license to use any feedback, suggestions, or ideas you submit about the Services ("Feedback") for any purpose without restriction or compensation to you. We are not obligated to act on any Feedback.
These licenses do not affect your ownership of your User Content. You can delete your stories and account at any time, which will end the active display license for that content (subject to distribution already in progress).
StoryPal and its licensors own all rights, title, and interest in and to the Services, including all software, algorithms, models, audio production pipelines, user interface designs, logos, trademarks, service marks, trade names, and all other intellectual property embodied in or related to the Services ("StoryPal IP"). These Terms do not grant you any rights in or to StoryPal IP other than the limited right to use the Services in accordance with these Terms.
The "StoryPal" name, logo, and taglines are our trademarks. You may not use them without our prior written consent, including in any way that suggests endorsement, affiliation, or sponsorship by StoryPal.
You may not copy, modify, reverse engineer, decompile, disassemble, or attempt to extract the source code of any part of the Services. You may not use any automated tools to scrape, index, or extract data from the Services without our express written permission.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services to:
We reserve the right to investigate any suspected violation of these rules and to remove content, suspend accounts, or terminate access without prior notice. We may report suspected illegal activity to law enforcement.
Stories generated by StoryPal are produced by artificial intelligence systems. Non-fiction stories are further supported by web research through third-party tools, but AI synthesis may introduce errors, omissions, outdated information, or misattributions.
StoryPal stories are intended for entertainment, general education, and creative inspiration. They are not a substitute for verified journalism, professional advice (medical, legal, financial, or otherwise), or authoritative reference material. You should independently verify factual claims in any story before relying on them for decisions.
We make no representations or warranties about the accuracy, completeness, timeliness, or reliability of AI-generated content. StoryPal is not liable for decisions made based on story content, whether fiction or non-fiction.
The Services may contain links to third-party websites or resources — including podcast platforms, social networks, and citation sources within non-fiction stories. We do not control these third-party sites and are not responsible for their content, privacy practices, or availability. Links are provided for convenience only and do not constitute an endorsement or recommendation by StoryPal.
Any dealings you have with third parties accessed through the Services are solely between you and that third party. We are not liable for any loss or damage arising from your use of or reliance on any third-party site or service.
StoryPal respects intellectual property rights and expects users to do the same. We will respond to valid notices of copyright infringement in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512).
If you believe content on StoryPal infringes your copyright, please send a written notice to support@story-pal.ai with the subject line "DMCA Notice." Your notice must include:
If you believe content was removed in error, you may submit a counter-notice to support@story-pal.ai including: (i) your physical or electronic signature; (ii) identification of the removed material and its prior location; (iii) a statement under penalty of perjury that you believe the removal was a mistake or misidentification; and (iv) your name, address, phone number, email, and consent to jurisdiction of the federal district court in your location (or in Massachusetts if outside the U.S.).
Upon receiving a valid counter-notice, we will forward it to the original complainant. Unless the complainant files an action seeking a court order, removed content may be restored within 10–14 business days.
We maintain a policy of terminating, in appropriate circumstances, accounts of users who are repeat infringers of intellectual property rights.

You agree to indemnify, defend, and hold harmless StoryPal, its officers, directors, employees, agents, licensors, and service providers (collectively, the "Indemnified Parties") from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:
We reserve the right to assume exclusive control of the defense of any matter subject to indemnification by you, and you agree to cooperate with us in that defense. This indemnification obligation does not apply to the extent that damages result from our own gross negligence or willful misconduct.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STORYPAL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT: (A) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE RESULTS OBTAINED FROM USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; (C) ANY AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR FREE FROM ERRORS OR OMISSIONS; OR (D) THE SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you in full.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STORYPAL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS — ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES — WHETHER IN CONTRACT, TORT, STATUTE, OR OTHERWISE — SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNTS YOU PAID TO STORYPAL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
If you are dissatisfied with the Services or any part of these Terms, your sole and exclusive remedy is to discontinue use of the Services. Some jurisdictions do not allow certain limitations of liability, so the above may not apply to you in full.
Before initiating any formal dispute, you and StoryPal agree to first attempt to resolve the issue informally. You must send a written description of your dispute to support@story-pal.ai, including your name, account email, a description of the issue, and the relief you are seeking. We will attempt in good faith to resolve the dispute within 30 days of receipt. If the dispute is not resolved within 30 days, either party may proceed to formal dispute resolution as described below.
If informal resolution fails, you and StoryPal agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services — including questions of arbitrability — shall be resolved by binding individual arbitration rather than in court, except as provided below. This arbitration agreement is governed by the Federal Arbitration Act.
Arbitration shall be conducted by a neutral arbitrator through a recognized arbitration provider such as JAMS or the American Arbitration Association, in accordance with their applicable consumer rules. The arbitration will be conducted in English. You may choose to participate by telephone, video conference, or written submission. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Either party may bring an individual action in small claims court for disputes within that court's jurisdiction. Either party may also seek emergency injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm while arbitration is pending.
YOU AND STORYPAL AGREE THAT EACH MAY ONLY BRING CLAIMS AGAINST THE OTHER ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING.
These Terms and any dispute relating to them shall be governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Massachusetts.
These Terms remain in effect for as long as you use or access the Services. We may suspend or terminate your account or access to the Services at any time, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent or illegal conduct, or that termination is necessary to protect StoryPal, other users, or third parties.
You may close your account at any time by contacting us at support@story-pal.ai. Closure of your account does not entitle you to a refund of any prepaid subscription fees.
Upon termination, your right to access the Services ceases immediately. The following sections survive termination: Your Content and Ownership, License You Grant Us, StoryPal IP, Acceptable Use, AI-Generated Content Disclaimer, DMCA, Representations and Warranties, Indemnification, Disclaimer of Warranties, Limitation of Liability, Dispute Resolution and Arbitration, and General Provisions.
Entire agreement. These Terms, together with our Privacy Policy and any additional terms applicable to specific features or services, constitute the entire agreement between you and StoryPal regarding the Services and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
No waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. A waiver of any breach in one instance does not waive future breaches of the same or other provisions.
Assignment. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. StoryPal may freely assign these Terms in connection with a merger, acquisition, or sale of assets. Any attempted assignment in violation of this provision is null and void.
Force majeure. We will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, war, cyberattacks, internet infrastructure failures, or government actions. We will use reasonable efforts to minimize the effect of such events and resume performance as soon as practicable.
Notices. Notices to you will be sent to the email address associated with your account or posted within the Services. Notices from you to StoryPal should be sent to support@story-pal.ai. Notices are effective upon sending (for email) or upon posting (for in-app notices).
No third-party beneficiaries. These Terms do not confer any rights or remedies on any third party other than as expressly stated herein.
Under California Civil Code Section 1789.3, users of the Services from California are entitled to the following consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
California residents waive California Civil Code Section 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
